The old adage states that an ounce of prevention is worth a pound of a cure.  Camping trips are no exception. The American Red Cross has some basic guidelines for you and your child to follow before embarking on a camping trip.  Follow these recommendations to reduce your risk of being injured while camping:

  • Discuss your camping plans with your doctor beforehand and get their approval before taking the trip, especially if you have any medical conditions.
  • Review the gear, supplies and skill set that you’ll need.  Think: What if you got lost, encounter an animal, become ill or injured?  Are you prepared to handle inclement weather?  Add to your hiking checklist the supplies you would need to deal with these situations.
  • Have the skills you need for your camping trip. You may need to know how to read a compass, create a temporary shelter or give first aid. Practice ahead so you’re prepared.
  • Get into good physical condition before you go out on the camping trip.
  • Make plans for proper acclimatization to altitude if you’re climbing in high altitudes.
  • Hike or camp with at least one companion. Have a minimum of 4 people in your group-one person to wait with you while 2 others seek help if you’re hurt.
  • Bring someone familiar with the area-at the very least speak to people who are familiar with the area beforehand.
  • Make any necessary reservations and get any permits beforehand. If an area is closed, do not go there.
  • Find out about regulations in advance-there may be rules about campfires or guidelines about wildlife.
  • Pack emergency signaling devices, and know ahead of time the location of the nearest telephone or ranger station in case an emergency does occur on your trip.
  • Leave a copy of your itinerary with a responsible person, including your car’s  make, year, and license plate, list all equipment, anticipated weather and expected return date.
  • Get trained in American Red Cross First Aid before starting out.

The next time that you embark on a day out in the park, follow a few safety tips to get the most out of your experience:

  • Listen to the ride operators’ instructions regarding safety equipment and how to enter and exit the ride.
  • Fasten available seatbelts, lap bars, and shoulder harnesses firmly, tug to ensure they are secure, and keep them fastened until the ride is complete.
  • Secure all loose articles such as sunglasses, cell phones, keys, hats, wallets, and other items in a zipped pocket, bag, or locker to avoid losing them or having them fly out during the ride and potentially injure other riders.
  • Do not attempt to take photos during the ride – it is easy for a camera to fall and break or cause injury.
  • Keep hands, arms, and legs inside the roller coaster car at all times to avoid hitting nearby supports, branches, and other objects.
  • Sit properly in the ride without twisting around, kneeling, or otherwise rearranging your body in a way that may compromise the effectiveness of the safety restraints.
  • If you do lose an object on the coaster, alert the ride operator but do not attempt to retrieve the object yourself, even if you can see it beneath the ride.
  • Never climb fences or otherwise enter restricted areas where the coaster or other dangerous equipment may be nearby.

Coney Island is a name synonymous with fun. Boardwalks, sand, sun, hot-dogs, and the infamous roller coaster ride called the Cyclone. But Coney Island drew attention for another reason in 2007 when the New York Post reported that an accident on its famous rickety Cyclone roller coaster resulted in death. A tourist broke his neck while riding the 80-year-old coaster and died from complications stemming from his injury. An accident or injury is not what you expect when you spend a day at an amusement park. In fact, neither did Keith Shirasawa, the victim of the roller coaster ride. When you find yourself involved in a roller coaster accident, come to the New York roller coaster accident injury lawyers with over two decades of experience. Michael Gunzburg, P.C. has an experienced team of lawyers that won’t let you get taken for a ride. We will fight to bring you the largest recovery available.

If you or someone you know has been injured at an amusement park, contact a New York Roller Coaster Accident Lawyer at Michael Gunzburg, P.C. today!

It is not always clear where to lay the blame for an accident. That’s why you need an experienced team of roller coaster accident lawyers behind you, fighting for you and your family. Keith Shirasawa was a California musician that was in New York in the summer of 2007 with his girlfriend, celebrating his birthday. Their day in the park first turned into a nightmare when he snapped his neck on the ride and had to be rushed out by EMS. He had broken three vertebrae in his neck, but was still alive and able to walk. He had emergency surgery to correct the problem and then one day later-was dead. Cyclone operators were not alerted, and a report of an accident was never filed with police or the city Building’s Department. The family was forced to prove that the Cyclone was ultimately responsible for their loved one’s death. Another accident in 1988 occurred when an 8-year-old girl choked to death on chewing gum after it became lodged in her throat. The incident occurred while she was riding the Dragon roller coaster at Playland amusement park in Rye, New York. The issue of who was at fault was a complex one. Then there are more straight-forward cases where the cause is very clear. In May of 1985 a 29-year-old man was also killed while riding Coney Island’s Cyclone roller coaster. He stood up during the ride and struck his head on a crossbeam. During a tragic time, you don’t have the extra energy to research the complex legalities and details required to determine who will be held accountable for your accident. You need expert guidance to review the facts of your case and arrive at the best plan of attack. Our firm can do that for you. We excel under pressure and when confronted by adversity. New York roller coaster accidents and injuries are our business.

Having an accident on a roller coaster when you want nothing more than a day of fun supports the notion that bad things do sometimes happen to good people. Sometimes unskilled workers, combined with loosely enforced regulations, and unpredictable accidents can be a formula for disaster. Let us sift through the facts of your claim and help bring the responsible parties to justice. You can’t control everything in life, but you can approach your next trip to an amusement park with caution and a little education under your belt.

Summer Series: Staying Safe and Healthy on Cruise Ships

We handle maritime and admiralty personal injury claims against cruise lines and related companies. Representation may be available for passengers and crew members injured by accidents, assaults or illnesses while on cruise ships.

Cruise lines owe a non-delegable duty to protect their passengers from crew-member assaults and safely transport their cruise passengers. And unlike most defendants, cruise lines are often vicariously liable for the intentional wrongful acts of their crew members, whether or not the acts were committed within the scope of employment. We provide our clients with the knowledge and expertise required to fully protect their rights as passengers or employees of a cruise line.

If you or a member of your family were injured on a cruise ship and need a Cruise Ship Injury Lawyer, please contact us for a free initial consultation.

Accidents and Illness
Cruise ship accidents and claims involve a part of maritime law that pertains to cruise ships only. While much of the general maritime law has general application to cruise ship matters, there are special laws that apply only to cruise ships. For example, cruise lines often limit the time within which a passenger may file a lawsuit against the cruise line to one year, even though the normal statute of limitations (time period to file a lawsuit) is generally three years (depending on the jurisdiction).

If you are injured while on a cruise line or you believe you contracted or suffered from an illness while on a cruise line, you need an experienced attorney who can navigate your claim through difficult waters.

Sexual Harassment and Assault on a Cruise Ship
We represent passengers and crew members who have been sexually harassed or assaulted on cruise ships, and we are able to handle even the most complex cases against the largest cruise line companies. These cases involve attacks by both passengers and crew members upon other passengers and crew members

General maritime laws, as well as state and federal law, impose strict liability on a cruise line company for sexual assault and sexual battery. Also, if a passenger or crewmember participates in any sexual act with a minor under the age of sixteen, this person has committed sexual assault or rape, regardless of whether the victim gave  their “consent.”

If you or a family member were sexually harassed or assaulted on a cruise ship, please contact us for a free initial consultation.

Diving and Spinal Cord Injuries also can occur around water, especially swimming pools, rocks, and piers. Diving related accidents can result in permanent paralysis, severance of the spinal cord, paraplegia and quadriplegia. Diving accidents can occur when the diving area is not large or deep enough and the diver hits the slope of a pool or the bottom instead of the deep water area. Horseplay can result in someone falling into the water and becoming injured, as can jumping into the water and landing on someone. The owners and operators of the swimming area are responsible to maintain the safety of these areas and are in the best position to protect swimmers from serious injury and death.

Accidents at Water Parks are also common and easily preventable. Steps can be slippery and dangerous due to black algae and lack of proper maintenance. The most common accidents at Water Parks are user’s body hitting something, collisions of two or more riders, tubes flipping over, and loading and unloading incidents. When the levels of Chlorine are not properly regulated by their operators, people have even gotten sick from high levels of bacteria in the water. Riders can also get seriously injured while going down a huge drop slide and unable to protect their crotch area experiencing a “Douche Injury,” which is painful and sometimes causes permanent injuries. The owners and operators of Water Parks are in the best position to protect users from these obvious and well known dangers of serious injury and death.
