$41 Million Awarded to Chicago Medical Malpractice Victim, Largest Award in Stroke Case to Date

A man who received negligent medical care resulting in a lifetime of disability was awarded a headline-making sum by a Chicago jury this week on Tuesday, May 14. According to local news reports, Chicago’s 25 News Now, former lawyer Craig Pierce was awarded $41 million for his medical malpractice case brought against OSF Healthcare, RenalCare Associates, Fresenius Medical Care of Illinois, and medical director Dr. Sudha Cherukuri for failing to provide proper after-care management of the blood-thinning medication Coumadin, which resulted in Mr. Pierce suffering a severe stroke.

Mr. Pierce first went to OSF St. Francis Medical Center in Peoria, Illinois in March, 2016 to be treated for a case of pneumonia. Mr. Pierce had apparently developed an injury to his kidney as a result of the illness, and his doctors diagnosed him with atrial fibrillation (AFib), a heart condition. Mr. Pierce was, ultimately, discharged from treatment at OSF, but was prescribed the blood-thinning medication Coumadin so that he could later undergo dialysis for his kidney injury. Mr. Pierce was set to receive the treatment at Fresenius Medical Care of Illinois, in Macomb, Illinois. However, the treatment did not go to plan because Mr. Pierce’s doctors failed to increase the prescribed doses of Coumadin, and on April 13, Mr. Pierce suffered a massive stroke. As a result of the negligent medical treatment and stroke, Mr. Pierce now is paralyzed on the left side of his body. Mr. Pierce also suffers from what are said to be “severe cognitive defects”, as a result of the stroke. Mr. Pierce was awarded $35.1 million for the medical malpractice, and his wife was awarded another $6 million in the case. According to Mr. Pierce’s lawyers, the result is the largest verdict ever to be handed down in a stroke case.

Of Mr. Pierce’s current condition, a press release indicated, “He has been unable to practice law, or function independently at all, and his wife Susan and grandchildren have provided him with 24 hour per day care at his home.” Fresenius Medical Care also released a statement about the jury’s award, stating “We respectfully disagree with the verdict which we believe was not supported by the evidence. With that said, now that the trial has concluded we hope the Pierce family is able to find closure during this difficult time.”
