New York City Hospital Forks Out Close to $8 Million in Premature Birth Medical Malpractice Lawsuit

A New York City hospital’s settlement of a premature birth medical malpractice lawsuit in 2022 serves as an example of how New York City medical malpractice patients can get justice under New York City medical malpractice laws for egregious and serious doctor errors. According to local news reports, 19-year-old Hakim Quick, Jr., agreed to a $7.75 million settlement with an addition $2 million Medicaid lien from his past medical care (he will pay $10,000 towards the lien under the deal) to resolve his claims against Jacobi Medical Center, which is part of the NYC Health and Hospital system. Quick was born prematurely back in 2003, at only 23 weeks old. A jury determined that the events and decisions leading up to Quick, premature birth were due to the negligence of the medical team treating Quick’s mother leading up to his birth. The jury found that, among other errors, doctors failed to adequately treat Quick’s mother for a previous diagnosis of incompetent cervix, and failed to monitor her with ultrasounds every two weeks. As a result, Quick was born prematurely and spent the first 16 months of his life as a newborn in medical care, requiring a breathing tube until the age of 5 and a feeding tube until he was 9 years old. He now can walk, but he has problems with balance, and needs assistance with stairs. Quick’s mother, Theresa Wilson, is currently his caretaker.

Although a jury awarded Quick $80 million in the medical malpractice lawsuit, the case was settled for $7.75 million in cash to Quick, as well as the Medicaid lien. Quick now will be entered into the New York State Medical Indemnity Fund, where he will be able to get help with his healthcare costs and expenses. Of her son’s horrific medical ordeal and the ensuing medical malpractice case, Theresa Wilson, says, “I would love people to know, never be afraid to speak up for your child.”
