What if the Insurance Company Says the Accident Was My Fault?
In a serious injury case where the costs are significant, you can expect the insurance company to try to limit their liability by pushing the blame for the accident on you instead of their insured. Even when it is clear their insured was at fault in causing the accident, the insurance carrier can still reduce its liability by saying you were negligent as well. New York’s “comparative fault” law means that when both parties share blame for the accident, the injury victim can only recover compensation in proportion to the other party’s fault. For instance, if your damages in a Brooklyn car accident add up to $100,000 but you are considered 30% at fault, then you could only recover 70%, or $70,000, of your damages from the other party.
