Jury Awards $1.5 Million in Nursing Home Bedsores Case – Rights of New York City Bed Sores Medical Malpractice Victims Explained

Almost nothing could be more horrific than learning that the medical professionals and medical care team that you trusted to care for your loved one committed malpractice and, instead, injured or killed them. It sounds catastrophic, unbelievable, and, perhaps, even morbid to think about, but the sad truth of the matter is that the medical care teams that we trust to give our family members excellent care sometimes fall beneath that standard. One of the most egregious ways that we can see the extreme negligence of a medical care team is when a patient suffers from severe bedsores. Unfortunately, a recent case in Maryland demonstrates just how bad bedsores cases are as a result of negligent medical care. In fact, we receive and handle many bed sore cases where the doctor, nursing staff and other people at the medical facility totally neglected the patient, and they developed severe bed sores on their back, rear end, legs and other extremities. All of these bed sores are highly preventable and all they require is reasonable patient care. Mr. Anderson’s case is just one example.

Bedsores to Bone Cancer – A Lack of Proper Care Leads to a Man’s Death

Earlier this year in February, news of a $1.5 million jury award in a Maryland medical malpractice case spread across local and national news outlets. According to local reports, the wife of patient Nelson Anderson was awarded the $1.5 million jury award by a Baltimore City jury in the case against the care facility that she alleged negligently treated him, leading to his death. Rose Anderson alleged in her medical malpractice complaint that Mr. Anderson died in May, 2021, as a result of a bone infection that he had developed from bedsores. Ms. Anderson alleged that nursing home staff at Autumn Lake Healthcare at Alice Manor had failed to care and treat the late Mr. Anderson, leading him to develop a stage 4 pressure ulcer. In addition to these horrific failures in treating Mr. Anderson, Ms. Anderson also “detailed numerous allegations of the nursing home’s alleged negligence, including the staff’s failure to treat Anderson’s wounds, recognize Anderson had a high pressure wound risk, and implement safety precautions.” Of the result, Ms. Anderson’s lawyers said, “These people’s lives are worth more – it’s not worth less because they’re older – it’s worth more…When there’s less life to live, each remaining moment is worth more, and so you’re taking more from these folks.” Ms. Anderson’s lawyers also pointed out the extreme nature of Mr. Anderson’s case, noting that, “You don’t get a stage 4 bedsore by the nursing home missing one turn…what we’re talking about with this significant of an injury, it’s an ungodly amount of the patient just being abandoned and left in that position over and over again.”  Mr. Anderson’s stage 4 bedsores could have been easily prevented if the nursing staff applied reasonable nursing care and attended to him, and turned and rotated him regularly. The jury understood this basic concept and that’s why they made the $1.5 million award to Ms. Anderson in this case.
