New York Giants Running Back Who Was Awarded $28.5 Million in Medical Malpractice Lawsuit Claimed Negligent Doctor Ended Football Career

In 2016, a Manhattan jury returned a verdict in favor of Michael Cox, a New York Giants running back, in a medical malpractice lawsuit against the estate of the doctor he claimed ended his career. The Giant’s player had been injured from a tackle during a game in 2014, and sought treatment for his injuries at New York-Presbyterian Weill Cornell Medical Center’s Hospital for Special Surgery, where he was treated by Dr. Dean Lorich. Lorich, who sadly committed suicide after treating Cox for reasons that are said to be unrelated to case, was found to have committed medical malpractice for “botching” Cox’s ankle surgery that same year.

The facts surrounding the Michael Cox case send a warning sign to New York City patients and residents about the potential for serious and permanent injury after doctors fail to fully treat a patient. In Cox’s case, after his ankle surgery was performed, Lorich cleared Cox to return to full rigorous football training, but he had not properly “handled” the injury that was affecting Cox’s cartilage in his ankle. As a result, Cox, who was drafted by the Giants in 2013, and who was still in a four-year contract with the team when the injury and botched surgery occurred, was waived two years after he was drafted. The jury, who found that Lorich, had, in fact, committed medical malpractice by failing to meet the required standard of care in treating Cox under New York Laws, ultimately awarded Cox damages in the amount of $12 million for past lost earnings from his career with the New York Giants, $1 million for past pain and suffering, and $15.5 million for future pain and suffering. However, while the damages awards for lost wages and past pain and suffering were unanimously awarded to Cox by the jury, the jury was split 5-1 on the award of future damages for pain and suffering. As for the estate of Dr. Lorich, attorneys representing the deceased doctor’s estate told reporters that they would be appealing the jury’s decision, stating, “We disagree strongly with the jury’s verdict and believe it was inconsistent with the evidence in the case.”
