New York Man Brings Medical Malpractice Lawsuit after Wife Dies While in Nursing Home Care, Bedsores, Broken Limbs Discovered

Earlier this summer in August, news reports about a New York man who lost his wife to alleged nursing home malpractice and the subsequent medical malpractice lawsuit that he filed in court came to light across New York state. According to local news reports, Charles J. Hupe, the husband of the late Michelle Hupe, brought a lawsuit in New York Supreme Court in Rensselaer County against the owners of the Evergreen Commons Rehabilitation and Nursing Center, as well as his late wife’s caregivers that he alleges injured and neglected her to death. Michelle Hupe was a patient of Evergreen Commons Rehabilitation and Nursing Center in 2017, when she was admitted due to a diagnosis of multiple sclerosis, which left her unable to speak and “functionally quadriplegic.” The lawsuit alleges that, among other things, Evergreen Commons failed to transport Ms. Hupe to Troy’s Samaritan Hospital for a scheduled surgery, due to an “unspecified accident” that led to a broken arm and swelling, and failed to treat and care for Ms. Hupe, which led her to suffer from painful and “massive” bedsores on her back. Ms. Hupe died in January of this year. Of the terrible pain and senseless death of Ms. Hupe, allegedly due to the actions and failures to act on the part of her doctors and caregivers, Mr. Hupe’s lawyers said, “The medical care and treatment rendered to the decedent Michelle A. Hupe while under the care of the Defendants and their agents…was negligently, unskillfully and carelessly performed….” Mr. Hupe’s lawyers added that Ms. Hupe “sustained serious and permanent physical injuries, was rendered sick, sore, lame, disabled, suffered trauma to her body and systems, suffered mental and physical pain, suffered anguish, suffered loss of opportunity for proper and necessary treatment….”

The case is ongoing and it remains to be seen whether Evergreen Commons and Ms. Hupe’s caregiving team will be held liable for her injuries and death.
