Victim of Anesthesia Malpractice’s Surviving Family Members Receive $15.4 Million Jury Award for Tragic Medical Malpractice Death
Certain close surviving family members of a woman who was killed as a result of botched anesthesia administration received news that the jury awarded $15.4 million in damages in their wrongful death lawsuit at the beginning of this month on July 3. According to local news reports, Fox 61, New Haven, Connecticut woman, 57-year-old Maria Ocasio, initially visited Midstate Medical Center for what should have been a brief outpatient scoping procedure, but later developed a fatal condition as a result of anesthesia malpractice. Ms. Ocasio was placed under anesthesia, as required for the scoping procedure, but she experienced collapse of her heart at the end of the procedure. Ms. Ocasio suffered severe brain damage as a result of the cardiorespiratory collapse, and she spent approximately one month in the ICU before she ultimately died in 2021. Ms. Ocasio’s family’s legal team in the lawsuit brought after her death alleged that Dr. Guy Aliotta, the lead doctor of her medical team, was negligent in failing to recognize what had happened to Ms. Ocasio, failed to properly resuscitate her, and failed to give her chest compressions or call a code, which they allege is standard procedure in such cases. The jury, apparently, agreed. A statement written by Ms. Ocasio’s sons, Alex, Luis, and Brian was released regarding the terrible medical malpractice death that read, “Our mother had to fight all of her life, and she would have wanted us to keep fighting. We are grateful to the jury for honoring her memory with this verdict…Her seven grandkids, one of whom was born after her death, were the light of her life. We will carry her memory and fighting spirit with us for the rest of our lives.” Ms. Ocasio’s legal team also released a statement about the case, noting that, “Maria Ocasio should have walked out of that outpatient procedure and enjoyed many more decades with her loving family – seeing her grandchildren grow up and benefit from the good lives that she fought for them to have. Instead, she spent her final days hooked up to machines…Her sons were determined to uncover what happened and honor her memory. Today’s verdict does just that, and we’re proud to have brought some peace to the Ocasio family.”
